RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-04560 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: 1. He be entitled to the Air Force Good Conduct Medal (AFGCM). (Administratively Corrected) 2. He be entitled to the Presidential Unit Citation (PUC). 3. He be entitled to the Air Force Outstanding Unit Award (AFOUA). 4. He be entitled to the Military Airlift Command Pride Award. 5. He be entitled to any additional awards he may be authorized. 6. His overseas service in Japan be recognized. ________________________________________________________________ APPLICANT CONTENDS THAT: He was never given awards or decorations he earned and they are missing from his DD Form 214, Armed Forces of the United States Report of Transfer or discharge. He requires proof for his Department of Veterans Affairs claim. In support of his request the applicant provides copies of his DD Form 214, AF Form 626, Temporary Duty Order – Military, AF Forms 899, Request and Authorization for Permanent Change of Station – Military, and various other documents associated with his request. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant served in the Regular Air Force from 26 October 1966 to 23 October 1970, to include one year and one month of Foreign Service. In a letter to the applicant dated 14 February 2013, AFPC/DPAPP advised the applicant that they verified and confirmed he had boots on the ground Foreign Service time at Tay Ninh Army Airfield, Republic of Vietnam from 30 May 1968 to 30 May 1969, for one year and one day. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSID recommends denial of the applicant’s request for award of the PUC and AFOUA. DPSID states that they are unable to verify he served with any units that received any of the aforementioned awards. Further, DPSID recommends denial of his request for entitlement to the Military Airlift Command Pride Award as it is a base level award and is not reflected on the DD Form 214. DPSID was able to verify his entitlement to the AFGCM and the Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P). Upon the final Board decision, administrative correction of his official military personnel record will be completed by AFPC/DPSOY. The complete DPSID evaluation, with attachment, is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 24 February 2013, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). _______________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice to warrant entitlement to the PUC, AFOUA, or the Military Airlift Command Pride Award. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice. We note the OPR was able to verify his entitlement to the AFGCM and the Republic of Vietnam Gallantry Cross with Palm and will administratively correct his record. Regarding his request to correct his records to reflect Foreign Service in Japan, the applicant has not provided sufficient evidence to persuade us that he served or was stationed in Japan.
